There may be nothing as tragic and unexpected as losing a child in a car accident. As an experienced fatal collision lawyer, Mr. Robinette has the skills and experience to help you through this most difficult time.

What help is available to parents who have lost a child in a Fatal Car Accident?

No parent of a healthy child expects that their child will precede them in death. Vehicle crashes are among the most unanticipated of deaths, most often happening on a normal day under normal circumstances. Every parent expects their child to return home after an evening out with friends. There are few traumas as great as getting the call or visit to inform you of the worst news of your life. Sadly, my own family received such a call when my sister was involved in a fatal collision thirty years ago.

Due to the nature of my work as a West Virginia car accident lawyer, I have frequently counseled parents after receiving this most horrific news. Unfortunately, there are legal issues that need to be dealt with after any major collision, especially those where serious injuries and death have resulted.

Few can really understand the pain you are experiencing, and when people try to minimize it, the hurt only increases. We realize that for each person killed, parents, siblings, teachers, and friends find their lives forever changed by what has happened.

The families of those children who are fatally injured are left to pick up the pieces of their damaged lives and start over again. It is our goal to provide the surviving family members with essential information to enable them to move forward after unspeakable loss and maximize their efforts to rebuild their lives.

Those families who have lost loved ones in fatal car accidents, truck wrecks, and motorcycle collisions have legal remedies to help with the financial aspects of their great loss through collision and wrongful death claims.

In West Virginia, surviving family members may seek compensation for:

  • Medical expenses prior to death
  • Funeral Expenses
  • Lost wages the deceased would have earned
  • Emotional trauma suffered by family members
  • Pain and suffering of the deceased prior to death
  • Loss of family and household services
  • Loss of companionship
  • Wrongful death

You don’t have to navigate the legal process alone. We will do everything we can to help you obtain the financial relief you need and deserve.

What Is “Wrongful Death” Under West Virginia Law?

Death, no matter the cause, is a sensitive topic for most people. Whether any particular death is “wrongful” in the eyes of the law will primarily depend on the reason the death occurred. All “wrongful” deaths have this fact in common: they are all premature deaths. But, not all premature deaths are wrongful. Let me explain further.

If a disease, such as cancer or a birth defect, causes the premature death of an individual and assuming all medical assistance was properly administered in a timely manner, then such individual’s premature death will not be considered a wrongful death in the eyes of the law. Similarly, if the natural aging process is the reason an individual’s health declines, and they die, then their death is not considered premature or “wrongful” in the eyes of the law either. But if an individual is fatally injured at any stage of their life by the negligent acts of another person, that individual’s death is both premature and wrongful. So, the death of an individual is “wrongful” when their death was a result of the negligent conduct of another person or company.

Car Accident Injuries

Jeff Robinette was hired by a young woman who had sustained permanent injuries to her foot due to an auto collision. The insurance company offered such a small amount and dealt with her in such a dismissive manner that the treatment of her case amounted to bad faith on the insurance company’s part. Jeff was able to obtain a substantial settlement which allowed this young woman and her husband to pay medical bills, buy a car and a home, and start building a future together.

Brain Injury

While timbering in WV, a heavy equipment operator sustained a permanent brain injury while performing the duties of his job. What price can you put on the loss of a fully functioning, fully reasoning brain? Jeff Robinette was able to negotiate a settlement that was annuitized to provide for this man for the rest of his life.

Crushed Leg Injury

Imagine having your leg crushed so badly in an accident that you have to undergo two surgeries to insert multiple pins and have a rod hammered into the bone just to stabilize the femur. Unfortunately, the first rod inserted into the bone didn’t accomplish the desired effect, so the rod had to be removed and surgically reinserted. Imagine the great pain, the months of therapy and recovery, and the frustration of knowing you can never return to the type of work you have performed for decades.

Jeff Robinette was able to obtain a great enough settlement to pay this man’s medical bills in their entirety and money enough to start a new business so he could work and live a productive life even with his permanent impairment.
